How They Find You

  1. The Swarm: When you torrent, you join a "swarm" of peers. Every peer can see the IP address of every other peer to facilitate data transfer.
  2. The Logger: Frommer Legal uses specialised software to join these swarms as a passive peer. They do not upload; they simply log every IP address that sends them data.
  3. The Match: They take this list of IPs to a court in Cologne or Munich. The court grants an order (Gestattungsanordnung) compelling the ISP to match the IP to a customer.

  • The 10-Year Risk: While the legal fees may expire after three years, there is ongoing legal debate regarding the "damages" (Schadensersatz) portion of the claim. Some courts argue this falls under a 10-year limitation period (Section 852 BGB).

  • Instruction: You had previously instructed these users not to use the connection for illegal file sharing (Instruction/Belehrung).
  • Security: The Wi-Fi network was adequately secured with a password and encryption at the time.
